WHY IS SJR 127 NECESSARY?
A 2000 decision by the Tennessee Supreme Court wrongly ruled in Planned Parenthood of Middle T
Tennessee v. Sundquist
that the Tennessee Constitution contains a fundamental right to abortion even broader than that affirmed by Roe v. Wade at the federal level. As a result, common sense state laws passed by the Tennessee Legislature were immediately stripped away including informed consent for women considering abortion, a 48 hour waiting period, and hospitalization for second and third trimester abortions.

Subsequently, laws requiring the regulation of abortion facilities have also been found to violate the new "state right to abortion" discovered by judges in the Tennessee Constitution. (Adams & Boyle v. TN Dept of Health.)

SJR 127 would allow for Tennesseans and our elected officials to once again determine abortion policy in our state

Now the battle moves to the State House under the able leadership Rep. Dolores Gresham (R-Somerville).


ABORTION AMENDMENT FAILS:

SJR0127   - Rep. Dolores Gresham (R-Somerville) Adds new provision to Article I to provide that nothing in Constitution of Tennessee secures or protects right to abortion or requires the funding of an abortion.

This amendment is so special, the Public Health Subcommittee held a separate meeting on Tuesday, February 26, 2008 (their regular meeting day is on Wednesday) in the largest House committee room to hear SJR 127.  It was packed out with supporters sporting big yellow “Let the People Vote” buttons and opponents labeled with “Vote NO on SJR 127”.  Full Health Committee Chairman Joe Armstrong (D-Knoxville) joined the eight-subcommittee members. (House rules permit a full committee chairman to participate and vote in any of that committee’s subcommittees – isn’t that special?) At 11:45 a.m. Chairman Mary Pruitt (D-Nashville) gaveled the meeting to order.

Dolores started by asking for a roll call vote and giving the history to explain the need for this Constitutional Amendment then continued with “all power is inherent in the people”.  She explained that a “yes vote affirms and celebrates the right of the people…a no vote steals what is inherently theirs and silences the people …no sound…no tongue…no voice…no freedom.”  She was wonderful!! Then the intense debate began with the Democrats doing a lot of accusing and venting – especially trying to paint this effort as a purely partisan and repeated election year ploy. When the dust settled, the vote was 3-6.

Removes provisions for certificates of driving; provides for temporary driver licenses for persons whose presence in the U.S. has been authorized by the federal government. VICTORY!!

RESOLUTION OPPOSING THE NORTH AMERICAN UNION

TENNESSEE TOLLWAY ACT.
